Dear Brian, If the property was sold or transfered into the UK Company then I agree there will be a 7% Tax to pay in Spain but this is treated as an Investment in Spain so there is a 1% Regional Transfer Tax calculated on the deed value instead of the 7%. There also is no Capital Gains tax implication in Spain when you invest a property into a UK Limited Company as the Hacienda has a method of calculating an investment value based on the original purchase price as shown in the Public deed. Spanish Tax Residents who are over 65 when they invest their main residence into a UK Company do not have any CGT liability in most Regions either.

My wife and I own a property in Spain and have looked at this option already. Unfortunately the Wincham website does not mention that the transfer of the property to a UK (or any other) Company is deemed under Spanish law to be a sale/purchase. The Company as purchaser will be liable for a tax of 7% of the property value. On the example quoted 7% of 300,000€ means an immediate tax bill of 21,000€ + spanish solicitor and Land Registry fees of course!
